Terms of Service

These terms explain how you may use Talona to discover leads, run outreach, manage conversations, and book meetings, and the responsibilities that come with authorizing an agent to act for your business.

1. The agreement

These terms are between you and Talona, Inc., a Delaware corporation at 131 Continental Dr, Suite 305, Newark, DE 19713, USA. By creating an account or using the service, you agree to them. You must be at least 18 and, if acting for an organization, have authority to bind it. A separate written agreement takes precedence where it expressly changes these terms.

2. What Talona does

Talona is a GTM agent for founders and small teams. It uses your ideal customer profile to research prospects and buying signals, enrich contact information, conduct outreach through connected accounts such as LinkedIn, X, and email, manage replies and follow-ups, and arrange meetings with calendar invitations and meeting links. Your plan and connected accounts determine which features you can use.

3. Accounts and authority to act

Provide accurate account information and protect your credentials and workspace access. Connect only accounts you own or have permission to use. Tell us promptly at hello@talona.ai if access is compromised.

When you authorize a goal or campaign and connect the required accounts, you authorize Talona to perform actions within those instructions. These may include researching people, sending messages and follow-ups, reading relevant replies, and creating invitations for agreed meetings without seeking approval for each individual step. Set accurate instructions, account permissions, and limits, and keep them current. You remain responsible for campaigns and representations you authorize.

You can withdraw instructions or revoke connected-account access. Revocation cannot undo messages already sent or events already created. Check the relevant account if an action needs correction or an invitation needs to be canceled.

4. Responsible research and outreach

You must comply with applicable privacy, direct-marketing, anti-spam, and platform rules. A contact’s availability in Talona does not establish permission to contact them. You are responsible for a lawful basis, required notices and consent, and accurate contact preferences.

  • Use accurate sender information and truthful messages. Include the identification, postal address, disclosures, and unsubscribe mechanism required for the channel and jurisdiction.
  • Honor opt-outs, objections, and requests to stop. Do not restart unwanted outreach through another account or channel, or remove suppression records to contact someone again.
  • Do not use stolen credentials, impersonate someone without authority, bypass access controls, or misrepresent your business or offer.
  • Do not collect or use personal information unlawfully, target children, or use sensitive personal data for prospecting.
  • Do not send harassment, phishing, fraud, or unlawful content, infringe others’ rights, or disrupt Talona or connected services.
  • Do not use lead scores or AI output to decide eligibility for employment, credit, housing, insurance, or other regulated opportunities.

Automation does not remove your legal responsibilities or ours. Talona does not grant permission to violate another platform’s terms or guarantee that an account will avoid restrictions.

5. AI output and booked meetings

Research, inferred buying signals, contact data, and generated messages can be incomplete, inaccurate, or outdated. Review material claims about your business and use appropriate oversight for the instructions you give. A verified email or phone number reflects a verification result, not guaranteed delivery, consent, or interest.

An interested reply and a calendar booking are different outcomes. A booking depends on agreement to the meeting details and successful creation of the invitation. Prospects may decline, reschedule, or fail to attend. We do not guarantee a number of leads, replies, meetings, customers, or sales.

6. Plans, credits, and payment

Credits pay for the data Talona brings back. A researched lead costs 5 credits, a verified email adds 3, and a verified phone number adds 15. Contact lookups only cost credits when a result is found.

Standard discovery is charged for new leads added to your list. Existing leads in the same workspace and unsuccessful contact lookups are not charged again. An optional refresh or deeper research gets a separate estimate before you run it.

See the credit estimate before a search starts. Work pauses when your balance runs out. Top-ups are optional, with no automatic purchases or overage charges.

Monthly credits stay valid for two billing cycles while your subscription is active. The oldest credits are used first. Top-up credits stay valid for 12 months and remain available after cancellation.

Current plan prices and allowances are listed on our pricing page. Additional service charges must be disclosed in the offer or order you accept. Subscriptions renew for their stated billing period until canceled. Cancellation takes effect at the end of the paid period unless applicable law or your order provides otherwise.

Fees exclude applicable taxes and are not refundable except where required by law or expressly agreed. Credits are service allowances with no cash value. We will notify you before pricing changes apply to an existing subscription. Free credits are subject to the trial conditions shown when offered.

7. Your information and intellectual property

You retain your rights in the information, prompts, and content you supply. You grant us the rights needed to process that content and perform the service you authorize. You must have permission to provide it and use the results. Third-party information remains subject to applicable law and third-party rights; research does not give you ownership of a person’s information or an exclusive right to contact them. We retain our rights in Talona’s software, documentation, and brand.

Personal information is handled as described in our Privacy Policy and any applicable data processing agreement. These terms do not replace a data processing agreement where one is legally required.

8. Third-party services and availability

Connected platforms and data providers operate independently. Their permissions, terms, availability, and restrictions can affect research, message delivery, and calendar access. You are responsible for your accounts and separate fees you agree to with those providers. We do not promise uninterrupted access or a specific uptime unless separately agreed in writing.

9. Suspension and termination

You may stop using Talona and request account closure. We may suspend or terminate access for misuse, nonpayment, a legal requirement, or a material threat to the service or others. Where practicable, we will notify you and allow an opportunity to resolve the issue. Retention and deletion after termination are governed by the Privacy Policy and applicable law. Ending access does not remove amounts owed or retract delivered outreach.

10. Disclaimers

To the fullest extent permitted by law, Talona is provided as is and as available, without implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant error-free AI output or success of every authorized action. Nothing here excludes a warranty or right that cannot lawfully be excluded.

11. Liability

To the extent permitted by law, neither party is liable to the other for indirect, incidental, or consequential damages, or lost profits or data. Our total liability is limited to the fees you paid us in the twelve months before the event giving rise to the claim. These limits do not apply to liability that cannot lawfully be limited.

12. Third-party claims

To the extent permitted by law, you will defend and indemnify us against third-party claims arising from your unlawful content, unauthorized account access, or use of Talona in breach of these terms. This does not cover claims caused by our own breach of law or these terms. We will notify you of a claim, cooperate reasonably, and not agree to a settlement imposing obligations on you without your consent.

13. Governing law

Delaware law governs these terms, without regard to conflict-of-law rules, and disputes are heard in the state and federal courts of Delaware. Mandatory protections and rights to bring a claim in another forum under applicable law are not excluded.

14. Changes

We will publish revisions here and update the effective date. Material changes will be notified before taking effect where required by law. Continued use after a validly notified change takes effect constitutes acceptance to the extent permitted by law.
